The following Terms and Conditions apply to the use of this Web site as well as all transactions conducted through the site.

All Transactions that are made with B.I. Scooter Rental LLC, dba B.I. Scooters, an authorized dealer for Sunny Sports Inc. are governed under the laws of the State of California which apply to and interpret your, B.I. Scooter Rental LLC dba B.I. Scooters and Sunny Sports Inc. rights, duties, and obligations arising from these transactions, as supplemented or modified by this Agreement, without regard to conflict law principles. B.I. Scooter Rental LLC, dba B.I. Scooters and Sunny Sports Inc. will only accept your order if:
* You Accept to the Terms and Agreement of this Terms of Sale Agreement, also known as ("Agreement")
* You Provide a valid Ship to address within the United States
* The Product of service is Available
You accept the terms of this agreement by clicking or check marking these terms and completing your transaction when ordering online or, when ordering by any other means, by opening the package containing the product, and/or having the shipment being delivered to your ship-to address.
Identity Theft Prevention
To protect the privacy and identity of our customers, when placing an order online if you request to have the merchandise shipped to a different address other than the billing address the customer must confirm with his/her credit card Company that they have added the shipping address as an alternate address. If the customer has a debit card and cannot change the shipping address and insists in shipping the order to another address other than the billing address the customer may need to fax a copy of driver license and credit card with a brief statement specifying that you agree to ship the order to a different address other than your billing address.
Order Processing
We will process your order to ship within 24-48 hours after the order has been confirmed with a live representative. Please make sure when ordering to give us the following information:
1.) Your complete name and address
2.) Specify if the address is commercial or residential
3.) Your phone number. The delivery company needs it and will
not deliver without a phone number.
4.) To better serve you, we suggest that our customers include 2 color choices. In the event that the first color choice is not available, we will ship you the second color choice to decrease delays in shipping. If while processing your order we find that either color that you chose is not available we will call you to let you know what colors are available.
Note: if we cannot get a hold of you via phone or email the order may be delayed until we confirm that you agree to switch the color and or model.
5.) Your email address, so we can send you a tracking number when the order ships out.
RESPONSIBILITY FOR MINORS
In cases where you have authorized a minor to use the Products and Services received from B.I. Scooters, you recognize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor's access to and use of the Products and Services; and (iii) the consequences of any misuse by the minor. B.I. Scooter Rental LLC, dba B.I. Scooters and Sunny Sports Inc. are not responsible for any injuries incurred as the result of an accident caused by misuse/careless driving of any sort of product sold and or advertised on our website. YOU ACKNOWLEDGE THAT THE PRODUCT THAT YOU ARE PURCHASING CAN ONLY BE USED BY A MINOR ONLY UNDER THE SUPERVISION OF AN ADULT.
Purchaser hereby certifies that He/She is over 18 years of age. Purchaser has carefully read the foregoing and acknowledges that purchaser understands and agrees to all of the above terms and conditions. Purchaser has had the opportunity to ask any and all questions regarding this agreement and the effect of the same. Purchaser is aware that by ordering and sending payments for any item(s), purchaser assumes all risks and waives and releases certain substantial rights that purchaser may have or posses. Purchaser therefor releases all liability and waives any and all rights purchaser may have in regards to purchases made of product directly or indirectly from B.I. Scooter Rental LLC, dba B.I. Scooters.
This Agreement shall be effective and binding upon my heirs, agents, personal representatives and assigns.
Limitation of Liability
In no event shall B.I. Scooter Rental LLC, dba B.I. Scooters and/or Sunny Sports Inc. or its suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site or items purchased on or through our site or this agreement (however arising, including negligence). Our liability, and the liability of our suppliers, to your or any third parties in any circumstance is limited to the Users cost of qualifying products purchased at the time of entering into the agreement. Qualifying products are acceptable for return as outlined in the Return Agreement.
Purchaser's Responsibility
You must inspect all equipment before using and take full responsibility for assuring that the equipment is in good working condition and safe to use. You further understand that you are responsible for any damages to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate purchaser's products, which removes all liability of the product sold to the Purchaser from B.I. Scooter Rental LLC dba B.I. Scooters and Sunny Sports Inc.
General
Any terms of this Agreement which by their nature extend beyond the Agreement termination in effect until fulfilled, and apply to both of our respective successors and assignees.
B.I. Scooter Rental LLC, dba B.I. Scooters will process, store and use information about your transaction and your contact information, include name, phone numbers, and e-mail addresses, to process and fulfill your transaction. Where permissible under local law, we may use this information to inquire about your satisfaction with our Products and Services, if we do so; you may at any time decline to receive any further communications from us. - Copyright

- Consumer Agreement

Some Assembly Required. In most cases and depending on which model purchased, it usually takes anywhere from 30 to 90 minutes to complete the assembly process of your vehicle. Our vehicles are usually 80% assembled at the factory and fully tested prior to shipping.To complete the assembly of your vehicle, you will need to properly install and/or assemble the contents included with your vehicle. Depending on the model purchased, these items are usually located in the storage compartment underneath the seat. For your safety, be sure to check and tighten all screws, nuts, and bolts prior to using your vehicle for the very first time and periodically thereafter. Depending on the length of time the scooter has been stored in the crate after factory testing, the carburetor may need to be cleaned due to possible sediment build-up. Detailed instructions on how to perform this procedure can be obtained by contacting our technical support team. Local pick-ups and optional assembly service is available upon request.
Remember! You are responsible for performing the setup and PDI (Pre-Delivery Inspection) that a dealer would normally perform (ie. installing rear view mirrors, setting up and connecting the battery, checking tightness of all screws, nuts, bolts, changing oil, etc.). In some instances, it may be necessary for your vehicle to be setup and tuned by a local service center. Items such as loose hardware and parts damaged from loose hardware and components are not covered under warranty. It is advisable to use a thread locking agent such as Loctite on all hardware to help prevent loss of hardware. Occasionally, on some units, it may be necessary to perform other routine checks or adjustments, such as adjusting the setting of the idle speed and fuel/air mixture screws on the carburetor, cleaning of the carburetor, checking to ensure wires are connected properly, adjusting chain slack and alignment (if applicable), in order to achieve optimum performance from your vehicle. We will gladly assist you with any additional technical questions you may have.
Prior to first use, it is mandatory to have the existing motor/engine oil (known as “packing oil”) replaced. The packing oil should be replaced with conventional four-stroke “Motorcycle Grade” (SAE 10W-40) engine/motor oil. Be sure to regularly inspect engine fluid levels to ensure that your vehicle operates safely according to manufacturer’s recommended specifications.

SHIPPING POLICY: The following is our shipping policy in general. See below for specifics of in/out of warranty shipping.
-All shipping related fees must be prepaid in full. Unless the customer is using Freight collect or has arranged his/her own freight.
-B.I. Scooters cannot guarantee delivery schedule.
-B.I. Scooters is not responsible for shipping delays.
-B.I. Scooters is not responsible for damages occurred during shipping.
-B.I. Scooters is not responsible for any extra cost incurred by the customer after the part has been shipped.
-B.I. Scooters is not responsible for return shipping costs and these costs must be included with the initial part order if not in warranty. If shipping funds are not included the part will not be shipped.
-B.I. Scooters is not responsible for any cancellation incurred cost. All incurred costs due to cancellation must be paid in full and are not refundable. (Example: If product or part has left the warehouse and the order is cancelled the shipping company will charge freight, whenever the product leaves our warehouse.)
Why do you need my part? We may need your part for several reasons.
* We need to verify your replacement part is the correct one to send to you.
* We require the part back so we may monitor defective parts and notify the correct manufacturer or potential future problems or recalls.
* We need to verify that your part is in fact defective. Many times we receive parts that are not defective at all.
* Items under warranty must send parts back to get free exchanges.
Shipping Information
General Shipping information: It takes approximately 48 to 72 business hours to process and ship an order once the order is confirmed over the phone with our live sales representative and the payment received. If an order is placed on Friday, Saturday or Sunday, please add an additional 24 hrs to the procession time for completion of the order. We do not ship on Saturdays, Sundays, or national Holidays. Sorry! We are not accepting international shipments at this time. Please refer to our shipping chart in reflection of the estimated time of arrival for all orders.

Warranty / Parts Warranty: Limited Warranty:
12 Months for engine and 90 days for parts. Please read below for additional details.
All warranty must be handled through the dealer where you purchased your products. Repairs deemed to be warranty related may be carried out by our certified technicians at our Chino, CA facility. It may be necessary to leave a credit card deposit prior to repair if repairs are suspected or deemed to be non-warranty related. Ie abuse, vandalism, accident etc.
If you cannot reach your dealer you will need to furnish a copy of your original invoice which must show our model number and VIN number on the invoice before we can warranty your product directly.
PARTS ONLY FOR ALL PRODUCTS
THIS LIMITED WARRANTY COVERS THE FOLLOWING PARTS ONLY:
Engine long block assembly, including all internal lubricated parts, i.e. Rings, pistons, pins, crankshaft and, main bearings, the connecting rods, and rod bearings, camshaft bearings, timing chain gears, rocker arms, valve springs, valve guides, valve seats, valve push rods, valve lifters, and oil pump. Additionally, the engine head(s), engine block and cylinder barrels will be covered if they are solely as a result of the mechanical failure of one or more of the internal lubricated components specified above. The Cooling system must be in good working order including cooling fans.
Accessory items, including but not limited to electrical components of all types (distributor, alternator and all sensors and electrical control devices), fuel systems, gaskets, seals, filters, mounts linkage and fluids are not covered by this agreement.
TRANSFER CASE: All internal lubricated parts contained within the transfer case. The transfer case itself will be covered if damage solely as a result of the mechanical failure of one or more of the internal lubricated components contained within the transfer case.
Accessory items, including but not limited to, U-joints, electrical components, linkage, seals, gaskets, mounts or fluids are not covered by this Agreement.
DIFFERENTIAL: All internal lubricated parts contained within the drive axle housing case. The drive axle housing itself if damaged solely as a result of the mechanical failure of one or more or the internal lubricated components contained the drive axle housing.
Accessory items, including but not limited to, backing plates, all brake system components, cables, controls, linkage, vents, pumps, U-joints, electrical controls, mounts, seals, gaskets, and fluids are not covered by this Agreement.
TRANSMISSION (Automatic or Standard): All internal lubricated parts contained within the transmission case. The transmission case itself if damaged solely as a result of mechanical failure of one or more of the internal lubricated components contained within the transmission case. The Complete hydraulic system must be flushed including integral transfer case, oil cooler, lines, and new filter(s) installed.
Accessory items, including but not limited to, modulators, governors, electrical controls, linkage, mounts, seals, gaskets, and fluids are not covered by this agreement.
COVERAGE AND LIMITATIONS: You must have a professional mechanic (any small engine repair shop, motorcycle shop, or local auto repair shop) or an authorized dealer assemble your new motorized vehicle and do the prep work to assure your vehicle is in good working condition. You will need to provide proof of this when filing a warranty claim example: invoice/repair receipt, Subject to the limitations stated in this agreement, Sunny Sports agrees (at its sole discretion and election) to replace a covered component if the covered component fails as a result of one or more of the internal lubricated parts within the component stated warranty period from the date of purchase, while the component is being used under the conditions and in the manner specified by its original manufacturer.
The following items are not covered under any circumstance.
Tires, rims, body panels, fuses, forks, shocks, gaskets, light bulbs, seats, CV Boots, oil filter, air filter, fuel filter, filters, clutch wear parts, cables, drive belt, chain, spark plug, any part made from rubber, belts, brake linings and/or pads, batteries, sprockets, external springs, clips, nuts, bolts, fasteners, frame.
Initial Preparation and delivery issues (DEALER ONLY): Items not covered by the warranty above may be covered under the initial set up of the vehicle if reported to Sunny Sports by the dealer.
Contact your sales rep for details.THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF ANY OF THE FOLLOWING IS TRUE:
-THE CUSTOMER DOES NOT USE A PROFESSIONAL MECHANIC (SMALL ENGINE REPAIR SHOP, MOTORCYCLE SHOP, OR AUTO REPAIR SHOP) OR AN AUTHORIZED DEALER TO ASSEMBLE AND PREP THE PRODUCT PRIOR TO OPERATION. Proof of this is required for warranty claims.
-THE DAMAGE TO THE COMPONENT IS CAUSED BY AN ACCIDENT.
-THE CUSTOMER FAILS TO FOLLOW THE MINIMUM MAINTENANCE AND BREAK-IN REQUIREMENTS SUGGESTED BY THE MANUFACTURER AND FAILS TO PROVIDE PROPER SERVICE DOCUMENTS.
-THE DAMAGE TO THE PRODUCT IS CAUSED DURING SHIPPING.
-PRODUCT IS USED IN A MANNER WHICH IT WAS NOT DESIGNED FOR.
-THE PRODUCT IS MODIFIED IN ANYWAY.
-THE PRODUCT IS USED IN RENTAL OR COMMERCIAL BUSINESS.
TOWING CHARGES: All towing and/or shipping charges incurred are the responsibility of the customer.
REPAIRED COMPONENTS: If the components are repaired under the terms of this agreement, they will be repaired or replaced with component parts of like kind and quality.
LABOR TO REPAIR OR REPLACE PARTS: B.I. Scooters does not pay or reimburse any labor cost under any circumstances.
S&H Charges and WHO pays:
IN WARRANTY: If your product is still under warranty you may return any part for exchange, at your expense, to our Chino California Distribution center. We will pay return shipping to you unless it is determined your part was abused or damaged other than manufacturers defect. Your dealer may handle the parts exchange for you at no expense to you however the option to do so is that of the dealers and we have no control of a dealers in house parts exchange policies.
Out of warranty: Customer is to pay for parts, S&H both ways and all labor charges.
In all cases you must send us the part that needs to be replaced. Failure to do so may result in your getting the wrong part. We are not responsible for wrong parts sent if we do not have your part to exchange and verify correct part numbers.LIMITED WARRANTY TRANSFERABILITY:
THIS WARRANTY IS NOT TRANSFERABLE.
NO IMPLIED WARRANTIES OR AGREEMENTS:
THERE ARE NO AGREEMENTS OR WARRANTIES, EXPRESSED OR IMPLIED INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE STATED IN THIS AGREEMENT. B.i. SCOOTERS SHALL NOT BE RESPONSIBLE FOR THE PAYMENT OF DAMAGES, OTHER THAN THE SUMS SPECIFIED IN THIS AGREEMENT AND LIMITED WARRANTY, FOR INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE ARISING FROM INJURY, LOSS OF USE, LOSS OF TIME, RENTAL VEHICLES, PROFITS, OR INCOME TO THE CUSTOMER AS A RESULT OF A FAILURE OF ANY COMPONENT OR PART.
NO OTHER AGREEMENT: There aren't other agreements between the parties with regards to the components purchased except as stated in this agreement & limited warranty.
REPLACEMENT PART: Sunny Sports reserves the right to inspect the defective part before replacing it. In some cases Sunny Sports will require customer to send in the defective part for inspection before exchange can be made. The inspection process might take from 2-4 business days after its arrival to the designated inspection office. Sunny Sports will decide if the part in question is defective or otherwise. Sunny Sports does not reimburse shipping fee.
It is the responsibility of the buyer and/or end user, and not B.I. Scooters, to ascertain, and obey, all applicable local, state, federal and international laws in regard to the possession, and use, of any item purchased from B.I. Scooters. All equipment is sold subject to public law and any local, state or federal ordinances or international law. End users must consult their local, state & country laws before ordering or purchasing products distributed by B.I. Scooters. The buyer agrees that absolutely no sales of any of our motorized products will be to minors. By placing an order, the buyer represents that the products ordered will be used in a lawful manner and that he/she is of legal age. B.I. Scooters will not be held liable for the misuse of any product purchased from us.The Content included in this Web site has been compiled from a variety of sources and is subject to change without notice as are any products, programs, offerings, or technical information described in this Web site. Order Cancellation Agreement Policy
Cancellations:
Cancellations must be made within 24 hours after the order is placed. Please NOTE that all cancellations are subject to a non-negotiable non-refundable cancellation fee of $75.00. Please contact a Customer Service Representative by phone ONLY to request a cancellation. You may only cancel your order and obtain a refund less the $75 cancellation fee IF the order has not been shipped and/or is not pending shipment. Once the merchandise is shipped, the order may not be cancelled. If you choose to cancel your order once it has been shipped, you will be responsible for the initial shipping freight charge, the return freight charge and also a 30% restocking fee to cover the time, labor and materials invested in preparing the shipment. All assembled fees, registration fees are non refundable, non negotiable. Please allow 7 to 10 business days for the processing of your refund after the order has been cancelled and or returned.
Shipment Inspection / Shipping Damage Claims Policy
It is our highest suggestion that you inspect your shipment immediately upon arrival, and note/notify Any and All Damages to the shipment, including damage to the shipping box (container). If there is any damage to your shipment, you must note this on the Bill of Lading when you sign for the package(s). You must also report any Damages to B.I. Scooters by telephone at (206) 251-3798 within 3 business days of receiving your shipment in order for us to file a claim of damages accrued on behalf of your shipment. If you report any damages during that time, B.I. Scooters will file the claim for you and determine means to remedy that situation, including but not limited to sending out replacement parts free of charge. If you do not report damages to B.I. Scooters within 3 days we will not be able to file any claims for you, and you may have to pay for parts to repair your product. In situations where you are accepting more than one package, please do a complete box count and write on the Bill of Lading of how many boxes you received before the driver leaves. If a package is refused without prior approval by B.I. Scooters, the restocking fee will apply. If your vehicle sustained structural and frame damages beyond repair, please refuse delivery and contact us immediately so we can prepare to send you a replacement unit. If you receive your vehicle with minor damages, please accept the vehicle and take pictures of damages and e-mail them to us at: sales@biscooters.com. We will send replacement parts to you free of charge.
Return Policy Agreement
Our Motto is to keep you satisfied. If after receiving your vehicle you decide that you no longer want your vehicle, give us a call and based on our return policy we will determine if the product can be returned or not. Steps on getting a product returned back to us:
* Obtain a Return Merchandise Authorization Number (RMA) from our Customer Service Department. Any vehicles returned without an RMA number will not be accepted. A copy of your original invoice must be included in a return shipment, as well as all MSO or legal documents contained with the vehicle.
* Customers who decide to return the product back to us are fully responsible for returning the merchandise at their own expense.
* Freight Collect and COD packages will not be accepted.
* Vehicle must be returned in its original packaging within 7 business Days in new and re-sellable condition. Such conditions will be inspected upon receiving of the product back to our warehouse. The transportation company will not pick up the merchandise if it is not on a pallet, is not packaged and secured; vehicle contains gas and or has the battery attached to it for safety purposes.
* This return policy/agreement does not apply to vehicles that have had alterations, abuse, negligence, accidents, or miss-use but certainly not limited to any other means which would not be considered manufacture defective or proper maintenance.
* All packaging materials, instruction manuals and parts must be returned. Any missing parts or damages will be deducted from your total refund amount. We do not accept any return vehicles that have any sustained damages while in transit back to our warehouse.
* If the vehicle has been used and fueled, 30% re-stocking fee may be applied.
* If you have received your vehicle for more than 7 days and have used it, you may not be eligible to return it for full refund or replacement. You can send the vehicle or parts to us at your own expense; we will repair it and send it back to you at our cost.
* B.I. Scooters is not responsible to reimburse any customer for any costs incurred to register and or insure a motor vehicle
